IARP - KU seeks alternative resolution
-
KU is seeking an alternative resolution with big-12 commish support from Bob Bowlsby for its case.
-
Just get it over with. Would be very happy to see this end finally
-
This either is a desperate tactic by KU, or the IARP is changing its rules midstream. And who can say which at this point. Chaos. Negotiated resolutions were not supposed to be an option once a case enters the IARP.
-
Just to clear this up the update does not state that an alternative resolution was accepted, only that KU requested it with support of the Big-12
-
With NIL here these cases just feel so behind the times.
-
I just found this… https://www.kansascity.com/sports/college/big-12/university-of-kansas/article256735322.html

That’s where you just have to shake your head. I would argue we basically have already taken punishment from this whole thing. Clearly on the recruiting trail we have…

Yes, but my feeling is KU, like the rest of us, are sick to death of the foot-dragging on the part of the NCAA/IARP.
Even murderers and other scofflaws have the right to a fair and speedy trial under the 6th amendment to the Constitution. I would submit this charade has been neither fair, nor speedy and we are being held in a perpetual state of incarceration.
@mayjay can probably chime in more on the legal aspects of this stuff, but from where I sit we are being treated worse than most criminals.
-
It feels like we are in a state that legalized recreational pot and then years later we go to trial on a possessions charge in that state.
-
@drgnslayr I almost posted this same exact analogy.
But it is more like being one of 10 people who were arrested for pot at a sold out Willie Nelson concert… and then pot becomes legal before we ever go to trial.

Yup, agreed we are all sick and tired of this. Also agreed that we’ve suffered plenty already. But remember this is the NCAA, so no right to a speedy trial. No 6th amendment protection here. Sucks.
I’m also guessing that KU is seeking a “plea bargain” here. Reduced charges in some way so they can be done with it.
Just my guess.

Totally agree and that was sort of what I was trying to illustrate - that we all have protections under the Constitution, but here we have a slow, and highly suspect, bureaucratic governing body with no checks and no balances that can essentially operate as they see fit with no repercussions. They pick winners. They pick losers. And they have no willingness to apply rules fairly across the board. The NCAA is starting to make the IOC look like choir boys.
Enough is truly enough. Just make a decision so we can move forward - whatever direction that takes us.

Did anything more come from the Zion family payment from Duke?
-
just heard our local sports talking with Jessee Newell about this latest IARP update asking him to try and clear things up like if things were leaning more towards KU walking clean nothing to worry about really and he responded NO - actually he had been hearing lately things were not looking good for KU. - -He was saying for people thinking KU was gona be fine and not to worry , he said that’ not what he had been hearing from people at all - - so I dunno
-
The interesting thing here is the IARP looks to be the one wanting a different kind of process, not KU. Wonder if they got through the infractions and were like oof there’s not 5 L1’s here

According to Jessee Newell it was KU was the one that wanted different. and was Backed by the Big 12 Commissioner , some thought maybe KU going this route to reach a settlement where punishment might be less severe, - -BUT also might be the other way too - - who knows. - let’s just get this over.
Like they said the longer this thing drags out it STILL has a effect on our recruiting

Why do you think the IARP is the one seeking a new process? Seems like KU initiated? @FarmerJayhawk

“Oct. 1 — “The Complex Case Unit requested a case management plan status conference to discuss the amended case management plan #2.”
Oct. 5 — “The Complex Case Unit submitted proposed draft procedures for an alternative method for the resolution of the case to the chief panel member. On that same date, the chief panel held a case management plan status conference to discuss scheduling deadlines and a request for an alternative method of resolution.””
From the IARP administrative timeline, it reads a lot like they want to cut a deal and took it to KU.
-
Yeah it certainly appears that way. If that’s true I would be optimistic

Yeah, it’s not like the IARP would or could publicize that they are wanting to cut a deal. Personally, I think it bodes well for us.

simply I think a lot of people think KU is gonna skate on this thing and to that I say I think your in for a rude awakening period. - If you think KU is coming out of this smelling like a rose - - then i’m sorry , but there is no way in hell we walk were gonna take a hit. - NCAA has been after us for so many years trying to find shit, and whether you believe it or not KU is not the innocent flower child in this whole thing we are not guiltless no matter the degree.
There other other schools that had less severity charged against them our 5 Level 1 and have gotten hit - no reason to think we will come out with less - i your thinking such then your in for a rude sold slap in the face called reality - -WATCH

Mike Vernon posted a bunch of stuff regarding this situation last night.
For those without Twitter basically the NCAA said no to KU and IARP coming to some other conclusion to the case.

@BeddieKU23 This is majorly disappointing. It just needs to end. From the time the infractions occurred to the point we finally get penalized it’ll be nearly 5 years. There won’t be a single player still on the roster at KU from when this happened.
-
Disappointing but as we have come to find out the only way the NCAA plays ball. There has never been a more tone deaf organization

Players will have enrolled, graduated, and gone on Soc Security…like Mitch is now.
-
The chaos continues. sigh. Of course it’s all behind secret super extra special locked doors. If not for a tweet or two from nobody involved, nobody would know a thing about it. Why?
-
@rockchalkjayhawk Maybe in addition to the players being gone they are waiting for a generation of fans to stop caring…or die off.

They are getting damn close @mayjay ! I mean, the lack of transparency in the process seems opposite of the intention of this “Independent” process. Maddening.

Oh your not satisfied with the timeline transparency that basically tells you nothing more then a sentence of something that may have occurred? How dare you! Of course I’m kidding. If this heads to court we may get even less transparency
-
@mayjay LOL

Something that may be 100% true is that everyone involved in this process is frustrated at the lack of a resolution. This has clearly gone past its due date and the milk is chunky and sour now.
