  • In Arizona these are he definitions and likely penalties:

    Under Arizona criminal law (revised statues), assault charges range from misdemeanor assault to felony aggravated assault. The statutes for assault also include charges for endangerment and threatening.

    Misdemeanor Assault

    A misdemeanor charge of assault can result from:

    • Physically injuring another person,
    • intentionally placing another person in “reasonable apprehension of imminent physical injury”, or
    • touching another person with them intent to injure, insult or provoke.

    Any actual physical injury (#1) will result in a Class 1 misdemeanor charge for assault. A Class 1 misdemeanor has a maximum sentence of 6 months in jail and a $2500 fine.

    The threat of injury (#2) will result in a Class 2 misdemeanor charge for assault. A Class 2 misdemeanor has a maximum sentence of 4 months in jail and a $750 fine.

    Touching with intent to injur or provoke (#3) will result in a Class 2 misdemeanor charge for assault. A Class 3 misdemeanor has a maximum sentence of 30 days in jail and a $500 fine.

    Aggravated Assault

    Aggravated Assault is a felony charge

    Aggravating factors that may may an assault offense an aggravated assault include:

    Any assault that results in a “serious physical injury”

    • causes temporary but substantial disfigurement or fracture
    • an assault using a deadly weapon
    • if the victim is restrained or captive
    • if the perpetrator is an adult, and the victim is a child 15 years old or younger.
    • is committed after entering the private home of someone
    • if the victim is a police officer, prison guard, firefighter, prosecutor, teacher, or medical professional.

    An aggravated assault charge is a Class 3 Felony. Under Arizona law, a class 3 felony offense carries with it a penalty of 5-15 years in prison for a dangerous offense, for which an aggravated assault qualifies.

    Second offense aggravated assault charges increase the severity to a possible prison sentence of 10-20 years.

    I will guess that the charges will be amended to a felony assault after a private financial settlement is reached and the injured party refuses to testify. Any more, that’s the American way, sue the wealthy and get a big payday.

    Doubtful… more like plenty of community service and an expensive lawyer bill… twice… one for the criminal case and one for the civil case.

  • Holy H. Moly! Between the cost of legal representation, the eventual probable financial settlement with the victim, and no-pay games of suspension levied by the league, that 4-year $52 million dollar deal is bound to take a huge hit. The loss will probably amount to more than poor ol’ Cliff Alexander will pocket in his first 3 years of NBA play. Just imagine the future culprit lining up to climb into the heads of the twins, offering up a ready-to-be-broken nose or a few bruised or dangling limbs for a piece of what’s left of that $52 million pie!

    Actually… I had the detached patella and ACLs, partial rotator cuff, broken ribs, and arthritis. The nose I already had fixed 20 years ago so I could breathe again. It would be nice to be compensated for all that. I can handle another nose correction after the check clears… might splurge for a knee replacement, too.

    So when are the twins due back in Lawrence for a visit?

  • As I understand it this family friend insults the boys mother and they get pissed. If they just go at him one at a time I would be fine with it. One on one fights happened now and then in our crowd to our mid 20’s. The problem is a patten of problems. And this time they ganged up on one guy-and to his credit he was trying to get away from them. . Add celebrity and money. Here comes the cops and robbers, er lawyers. (Ps-if someone here is a lawyer no malice-just humor.)
